Motion for Summary Judgment Granted in Roof Damage Litigation Following Undisclosed Subsequent Insurance Claim

We are pleased to share a significant litigation outcome achieved by our team in a disputed January 2022 windstorm claim in St. Lucie County.

After over a year of litigation, it was discovered just prior to a court-ordered second mediation that the plaintiffs had filed a subsequent claim for Hurricane Nicole damages, for which they were paid over $60,000 for full roof replacement and extensive interior repairs. This subsequent claim had not been disclosed to their counsel, nor was it revealed in their interrogatory responses or depositions, despite clear relevance.

During mediation, this information was presented in a breakout session with plaintiffs’ counsel and the mediator. The plaintiff, when questioned, appeared evasive and ultimately exited the mediation without returning. In the following weeks, plaintiffs’ counsel withdrew from the case, and a Motion for Summary Judgment based on the undisclosed subsequent claim was filed and granted on May 15, 2025.
